Hidden Nanny Cams
This particular kind of camera is one that it is hidden. It’s usually hidden in devices like alarm clocks or even something like a stuffed animal. It will let you privately monitor a babysitter or nanny without their knowledge. Legal ramifications aren’t something you have to worry about, since all 50 states give their residents the right to secretly videotape the contents and visitors of their home, even without consent. Having said that, exceptions exist for bathrooms and private areas, such as a nanny’s bedroom. That kind of videotaping is highly illegal.
One big caveat to note here is that hidden cameras are only permissible if their recording is strictly video. A handful of states won’t let you record audio of a nanny, babysitter, or au pair without their consent or knowledge. So, if your camera is audio and video, you have to notify the person, even if it’s a hidden camera. Failing to do that can range in situations anywhere from the loss of evidence to your own prosecution. Instead of being able to bust them for something you recorded, you can be sued yourself, and your recordings aren’t admissible in court.

Exposed Indoor Cameras
Recording baby monitors and interior home security cameras land in the exposed nanny cam category. These kinds of cameras are not hidden, mounted in the plain sight of all around your household.
Hidden camera laws also apply for exposed cameras. If these cameras also record audio, you have to tell your babysitter, au pair, or nanny both verbally and in a written statement. That prevents your own prosecution if you ever try to use such recordings as court evidence. If you want to make sure there’s no doubt regarding your disclosure, it’s a good idea to do the notifications in front of a camera and getting their signature.
